The Clerk of Courts Office accepts payment for bail for all criminal cases pending at the Court of Common Pleas. District Courts accept bail for cases pending in their jurisdiction during office hours. After hours and weekends, bail can be posted for District Court cases at the Montgomery County Correctional Facility, 60 Eagleville Rd, Eagleville, if the defendant is housed there.
In the Clerk of Courts Office, bail is accepted during office hours (8:30 AM to 4:15 PM). It is suggested that you arrive at least one half hour prior to the office closing.
Forms of payment accepted for the payment of bail is cash. Money orders, credit cards and checks are not accepted for bail.
Please bring identification with you. You must be at least 18 years old to post bail.
If you become surety for the defendant, you become personally responsible for the entire amount of the bail unless you relinquish any claim for the bail money and place the bail money in the defendant’s name.
Unless bail has been forfeited for failure to comply with conditions of the bond, bail money less any administrative fees, will be returned to the surety after expiration of the 30 day appeal period (except in ARD cases, for which there is no appeal period). If the case is appealed to higher court, bail will be held in escrow until full and final disposition.
